Mark Curnutte started covering the Bengals and the NFL for The Enquirer in 2000. He previously wrote about urban affairs and other social issues for the Enquirer. He won the prestigious 1994 Unity Award from Lincoln University (Missouri) for "A Polite Silence," a seven-day series about race relations in Greater Cincinnati. He also has worked as an assistant features editor and features writer at The News & Observer in Raleigh, N.C. Curnutte is second vice president and a three-year board member of the Professional Football Writers of America (PFWA). He is a 1984 Miami University graduate.

Henry incident at Newport Levee

A valet parking attendant at Newport on the Levee allegedly got into a confrontation with Bengals wide receiver Chris Henry and another man over a $5 parking charge Tuesday.

Bellevue resident Jason C. Baker, who intervened and tried to resolve the dispute, ultimately filed a menacing and harassment complaint with Newport police shortly before 7 p.m. Tuesday.

Henry has not been charged with a crime.

The Bengals reinstated Henry to the 53-man roster Monday. He is coming off an eight-game suspension for violating the NFL’s personal conduct policy and is expected to play Sunday at Baltimore.

Is the incident enough to jeopardize Henry's status for the game?

"Based on the info below, the answer would be no," NFL spokesman Greg Aiello wrote in an e-mail to The Enquirer after viewing this report. "It is not an issue in terms of his playing status at this time."

Aiello is NFL Senior Vice President of Public Relations.

Henry spoke to the media earlier today.

"I'm really excited to get out there and help my teammates," he told a group of reporters and TV cameras.

Bengals coach Marvin Lewis, through a team media relations official, said Henry had been told only to answer football-related questions. Henry would have no comment on the Newport incident, Bengals spokesman Jack Brennan said. The club had no additional comment as of 3 p.m. The Bengals view it as a non-substantive issue, Brennan added.

According to the incident report, the valet parking attendant approached Henry and Desious Dyneal Alston, 24, after they parked a Land Rover without paying and started walking away Tuesday. The valet, according to the incident report, said Henry started arguing with him about parking when Baker approached and tried to resolve the argument.

According to the incident report, Baker told police that Henry came up to him and, chest to chest, said, “(Expletive) you. (Expletive) this. Don’t you know who I am?” before throwing a $5 bill on the ground and saying, "You better pick that up (expletive)."

Henry and Alston left the Newport on the Levee in the Land Rover but later returned, the incident report said. Police were called back to the entertainment complex and Henry and Alston were banned from the complex, the incident report said.

Baker located an officer a few minutes later, according to the incident report, and said Henry and Alston had walked past him on the way to an elevator and told him, "(Expletive) you. You better hope I don’t see you again."

Baker has not returned a phone message seeking comment.

To pursue charges against Henry would require a visit by Baker to the Campbell County Attorney's office, which would review the incident and decide if charges were appropriate. There’s also the possibility that the county attorney would require the sides to go through mediation before the issuance of charges.

"Legally any misdemeanor such as this needs to be filed within one year," Campbell County Attorney Justin Verst. "But as a practical matter the longer somebody sits on it and doesn’t do anything the less serious we're going to take it."

Simple Solution.... He is a "Celebrity". dont put yourself in position to have this happen. You got money, use it. Thats why they pay these guys so much. In response to the reporting. I agree, Its a valet trying to get attention. A Menacing charge is a low misdemeanor, and to get him violated over 5 dollars is CRAZY, AND UNCALLED FOR. GROW UP

Yeah, the valet was just baiting Chris Henry...the valet forced Henry to return, after the incident, and threaten the valet....Right...just like that waiter Ron Goldman was just trying to get attention by baiting OJ...

Chris Henry has even less self-control than OJ.

Chris Henry could've avoided the whole situation by simply peeling 5 bucks off his multi-million dollar bank roll and paying for parking like any reasonable member of society would. Then he goes to the "do you know who I am card"...classic. There are only 2 answers to that question: yes I know who you are and I don't care...that'll be $5 to park; or, no, I don't know who you are, which means you are not nearly important enough to be comped parking, that'll be $5 please. Chris Henry is a complete joke. Even if the guy was baiting him as many of you claim, Chris doesn't have enough self control to walk away. This is story has as much credibility as the time Henry beat up a 16 year old, or the time he had a stolen car in his driveway that the cop just happened to check because he didn't recognize the car. Or how about the time Odell and his brother supposedly put a gun in someone's mouth. Instead of wasting time calling the NFL, how about getting the videotape from Newport on the Levee, or possibly even getting an account from the person who reported this in the first place.

In this case I will defend Henry. The parking attendants are rude and really not necessary at the Levee. When the place first opened you could pay after you left the place and could do so automatically which was great and cut down on the traffic. However you had a bunch of city workers with nothing to do so someone had a great idea to make people pay with cash when you enter the lot. Which is why I avoid that place like the plague outside of opening day for the 3 dollar parking.

Not a big deal on this issue...though I still say he should be in the Florida prison system for the gun charge a couple years ago.

Calling the NFL to see if an incident like this would call for another suspension isn't bad reporting, it's legitimate reporting, but some aren't smart enough to see it

People - hold on a minute. The statement "...do you know who I am"? supposedly made by Chris Henry proves right there that he is innocent, probably not even in Newport that night. Think about it... why would any Bungle player pose that question knowing that there would be a distinct possibility that someone would recognize him. Who in their right mind would ever admit to (willingly)playing for the Cincinnati Bungles?

Two people corroborated this story, so I don't think it is a valet "just looking for attention." I've had it with Henry- I want the NFL to suspend him again and then the Bengals cut him. I am at the point that I'm ready to stop following the NFL at all if they keep employing these thugs. I already stopped following the NBA some years ago for the same reason.

Nice job, Mark, on responsible reporting. It's refreshing to see a reporter who's not too biased or spineless to write about the "bad" in his beat.

Chris Henry is a waste. How can anyone defend this guy? Apparently not too hard for Marvin Lewis, who on NFL Radio Thursday morning made comments about Henry having his rights violated and how he was not treated with dignity. Yeah, because throwing money on the ground and telling a worker to pick it up is all about dignity. Keep defending these thugs you've brought in, Marvin. Thanks for ruining my beloved childhood team.

People need to get off the cross-we need the wood! Anyone can call anyone else anything they want out on the street, whether it is Newport on the Levee or walking down the street in Over the Rhine. It's not illegal, it's not harrasment, I use a wide range of shouted expletives when required and I have yet to be charged with menacing. If everybody who was ever shoved filed charges we would be a society of pansies. Probably because. The valet guy was probably an anal retentive-wanna-be-a-cop-a**hole like some of the security guys down there. Jason Baker is probably the kid that got his tail kicked once a week in school and has trouble meeting women. Stuff happens. Get over it. Nobody was ever in danger. Nobody was injured-except for someone's pride or ego. Henry is a target, primarily in Kentucky, and this crap is going to happen wherever he goes. As a side note, to ban someone who did no actual damage from a public place for 5 years is petty and stupid. I hat eto say this, I am VERY against this, but I believe had it been an unknown white guy with the same situation there would have been no drama...
